Before you hire anyone, ask these five questions.
1. Do You Handle Cases Like Mine?
Family law is a broad practice area. An attorney who focuses on high-conflict custody battles requiring weeks of trial preparation is a very different lawyer from one who helps couples finalize straightforward uncontested divorces. Neither is better — they just serve different needs.
Before you commit, be specific about your situation. Are the issues genuinely disputed, or are you and your spouse largely in agreement? Are there children involved? Is this a straightforward dissolution, a prenuptial agreement, or an adoption? Make sure the attorney you are considering regularly handles matters like yours — not just family law in general.

2. How Do You Charge, and What Will This Actually Cost?
Fee structures vary significantly in family law. Some attorneys charge by the hour, which can make costs difficult to predict. Others offer flat fees for defined services — a complete uncontested divorce, a prenuptial agreement, or an adoption — which gives you cost certainty from the beginning.
Ask specifically:
- Is this a flat fee or an hourly rate?
- What is included, and what might cost extra?
- What is your retainer, and how is it applied?
- What happens if the scope of the matter changes?
A good attorney will give you a clear, honest answer. If you cannot get a straight response about fees before you hire someone, that tells you something important about how the relationship will go.
3. Will You Be Handling My Case, or Will It Be Passed to Someone Else?
In larger firms, it is common for a senior attorney to handle the initial consultation and then pass the file to a junior associate or paralegal. There is nothing inherently wrong with this — but you should know it going in, and you should know who your primary point of contact will be.
In smaller practices, you typically work directly with the attorney throughout. Ask clearly: Who will be drafting my documents? Who will I call when I have a question? Who will appear at my hearing?
4. How Do You Communicate, and How Quickly Do You Respond?
Poor communication is one of the most common complaints clients have about attorneys — and it can cause real harm to your case. Missed deadlines, unreturned calls, and vague status updates create anxiety at an already stressful time.
Ask about the attorney's communication practices before you hire them. Do they respond to emails? Within what timeframe? Will they call you when something significant happens in your case, or do you need to call them? These are not unreasonable questions, and a good attorney will not be offended by them.
5. What Is Your Honest Assessment of My Situation?
This is perhaps the most important question — and the most revealing. A good attorney will give you an honest, realistic picture of what to expect, including the parts you may not want to hear. An attorney who tells you only what you want to hear is not serving your interests; they are managing your feelings at the expense of your outcomes.
Ask them directly: What are the likely outcomes here? What are the risks? What would you do if this were your family? An attorney who can answer these questions honestly and clearly — without overpromising or hedging everything into meaninglessness — is someone you can trust.
